1. Purpose

These Terms and Conditions govern the services provided by GoFuckingMove. The service is based on a weekly subscription that allows users to set sports goals to be achieved. If the goal is not met, a debit will be made from their credit card.

A goal consists of the following elements:

• A sport discipline (e.g., running, swimming, hiking, etc.).
• An objective, which can be:
  • A minimum distance to be covered (in kilometers).
  • A total duration of sessions (in minutes).
  • A total number of activities.
• A subscription fee that will be charged in the event of failure to meet the goal.

A week is defined as running from Monday to Sunday, UTC time.

2. Subscription and Renewal

Each goal created on GoFuckingMove is associated with a weekly subscription that is automatically renewed every Monday during the goal verification process. Users can cancel their subscription by deleting a goal in the "Manage my goals" section without prior notice. Once a goal is deleted, no further verification will be made for it on the following Monday.

A user can have multiple goals at the same time. Each goal is a distinct subscription, subject to its own conditions for verification and payment.

3. Verification on Strava

Goals are verified every Monday for the previous week. Verification of goals is based on data provided by Strava, taking into account the specific objective defined by the user (distance, duration, or number of activities). Only the selected activities will be considered, and they must exactly match the activities recorded in the user’s Strava profile.

If Strava is unavailable at the time of verification, GoFuckingMove will perform the verification later in the week once Strava’s services are restored. The date and time of this delayed verification will be indicated in the "Performance" section of the user's personal space. During this period, no direct notification will be sent to the user.

In case of a discrepancy between the user’s recorded data and the verification, the user may contact our support team at [email protected] to request a manual review. For this, the user’s Strava account must be set to public during the review period.

4. Payment

A debit will only be made if the user fails to meet the sports goal they have set for the week. Payments may occur later in the week after verification is completed. A specific payment method (credit card) is associated with each goal, allowing for independent handling of multiple goals. Users are required to provide and maintain valid payment information for each goal they create.

Payments are processed by Stripe, and GoFuckingMove does not store any banking information. Only credit card payments are accepted.

5. Right of Withdrawal

In accordance with Article L221-28 of the French Consumer Code, the user may exercise their right of withdrawal as long as no goal verification has been carried out. Once the first goal verification takes place, the service is considered fully executed, and the right of withdrawal no longer applies.

6. Limitation of Liability

GoFuckingMove makes no guarantees regarding performance results. The service is designed as a "self motivator" and relies entirely on the user’s personal motivation to achieve their goals. No refunds or compensation will be provided if the user fails to meet their goals.

7. Subscription Cancellation

The user may cancel their subscription at any time by deleting their goals from the "Goals" section of their personal space. No verification or debit will be made for a deleted goal.

8. Prohibited Uses

Users are strictly prohibited from engaging in any activity that may compromise the security, integrity, or proper functioning of GoFuckingMove’s services and systems. This includes, but is not limited to:

• Attempting to hack, exploit, or otherwise gain unauthorized access to any part of the service.
• Circumventing any technical measures implemented to protect the service.
• Exploiting any bugs, glitches, or vulnerabilities to gain unfair advantages or harm the service.
• Interfering with or disrupting the normal functioning of the service, including through the use of automated systems, bots, or any other means designed to overload or damage the infrastructure.

GoFuckingMove reserves the right to take immediate action, including suspending or terminating accounts, and pursuing legal action against individuals or entities that engage in any prohibited use of the service.
